ACCEPTABLE USE POLICY
This Acceptable Use Policy (this “Policy”) governs your use of the services (the “Services”) made available by Cloud Solutions International, LLC (“Fybe,” “we,” “us,” or “our”) through our website (fybe.com) and any successor or related locations designated by us (our “Site”). We may modify this Policy by posting a revised version on the Site. By using the Services or accessing the Site, you agree to the latest version of this Policy. Capitalized terms used in this Policy but not defined will have the meanings set out in our User Agreement, made available here.
You may not use, or facilitate or allow others to use, the Services or the Site for any prohibited activity as set out in this Policy. Prohibited activities include:
Illegal, fraudulent, or abusive activities, including, without limitation, using the Services or the Site to:
engage in, further, promote, or encourage illegal conduct or activities, including the dissemination of Content that has been determined by a court of competent jurisdiction to be unlawful;
engage in activities that are deceptive or harmful to others, or that would harm Fybe operations or reputation, including offering or disseminating fraudulent goods, services, schemes, or promotions (e.g., pyramid schemes, phishing, or pharming), deceptively impersonating another person or entity, or engaging in other fraudulent or misleading practices;
disseminate or distribute child pornography or depictions of nudity or sexual activity obtained or distributed without the consent of those depicted (e.g., "revenge pornography");
disseminate or distribute Content that incites or threatens violence against any person, promotes terrorism, is intended to harass, abuse or invade the privacy of any individual, creates a risk to the physical safety or health of any individual or to public safety or health, or that threatens or encourages harm on the basis of race, ethnicity, national origin, religion, caste, sexual orientation, sex, gender, gender identity, serious disease or disability, or immigration status;
violate, infringe on, or misappropriate the intellectual property or proprietary rights of any third party, including without limitation any rights in or to copyright, patent, trademark, trade secret, privacy or publicity, and publishing content intended to assist others in unlawfully circumventing technical measures intended to protect any such rights; and
unlawfully sell or distribute controlled substances, including but not limited to any illegal or prescription drugs;
Violating or tampering with the security, integrity, or availability of any network, computer, or telecommunications system, software application, or network or computing device, including, without limitation:
distributing, publishing, or sending, any harmful software, including, without limitation, any Content, software, or any other technology that may damage, interfere with, surreptitiously intercept, or expropriate any computer system, program, or data, including any viruses, malware, spyware, adware, Trojan horses, worms, or time bombs, or facilitating the distribution, publication, or transmission of the foregoing;
accessing or attempting to access the Services or the Site without authorization
probing or attempting to probe, scan, or otherwise test the vulnerability of the Services, the Site, or any telecommunications system or infrastructure supporting the Services or the Site;
breaching, circumventing, or attempting to breach or circumvent, any security, authentication, or usage limitation measures employed by Fybe (e.g., access rights or storage capacity limitations);
monitoring data or traffic on the Services or the Site without permission; and
falsifying, forging, or otherwise producing misleading TCP-IP packet headers, e-mail headers, or any part of a message describing its origin or route, except for the use of aliases or anonymous remailers; and
Misusing the network resources and telecommunications infrastructure supporting the Services or the Site, including, without limitation:
making network connections to End Users, hosts, or networks without permission or authorization, including monitoring or crawling third-party sites or systems in a way that disrupts or impairs the sites or systems being monitored or crawled and harvesting or scraping any Content hosted on the Services (including Content of End Users without permission);
collecting, transmitting, or using information, including email addresses, screen names, or other identifiers without permission;
interfering with the proper functioning of the Services or the Site, including any deliberate attempt to overload the Services by mail bombing, news bombing, broadcast attacks, flooding techniques, or conducting a denial of service (“DoS”) attack;
operating open proxies, open mail relays, open recursive domain name servers, TOR exit nodes, or other similar network services;
engaging in any conduct that is likely to result in retaliation against Fybe, including engaging in behavior that results in Fybe being the target of a DoS attack;
falsifying, forging, withholding, or cloaking identity or contact information, including deleting, forging, or misreporting any transmission or identification information, such as return mailing or IP addresses.
Fybe is entitled to define usage limits. Exceeding these usage limits will constitute a violation of this Policy for which Fybe may suspend or terminate your access to the Services in accordance with the User Agreement.
DISTRIBUTION OF COMMERCIAL OR BULK ELECTRONIC MESSAGES
You must comply with the laws and regulations applicable to bulk or commercial electronic messages (“messages”) in your jurisdiction and in any other competent jurisdiction. In addition, any messages sent by you through the Services must meet the following requirements:
you must have the means to track anonymous complaints;
you must not obscure the source of any message sent through the Services in any manner;
you must provide an email address for complaints in a conspicuous place on any website associated with the message, and you must promptly respond to End User requests sent to that address;
your intended recipients must have given their consent to receive messages via some affirmative means, such as an opt-in procedure, and you must produce evidence of such consent within 72 hours of receipt of a request by the recipient or Fybe;
you must use reasonable means to ensure that the person giving consent to receive messages is the person authorized to provide such consent;
you must honor revocations of consent and notify recipients of the same.
INVESTIGATION AND ENFORCEMENT
We may investigate any suspected violation of this Policy and remove or disable access to any Content, material, or resource that violates this Policy. You agree to cooperate with us to remedy any violation of this Policy, including, without limitation, repairing, correcting, or modifying any program, software, or executable deployed on the Services. You agree that we may quarantine or delete any data or Content stored on the Services or isolate, terminate, or remove any program, software, or executable deployed on the Services, in our sole discretion, if we believe there is a violation of this Policy or if we believe such action is necessary to preserve the availability and functionality of the Services for other customers or End Users.
When determining whether there has been a violation of this Policy, we may consider your ability and willingness to comply with this Policy, including the policies and processes you have in place to prevent or identify and remove any prohibited content or activity.
REPORTING OF VIOLATIONS
To report any violation of this Policy, please use Fybe Abuse Report Form.
Please be aware that the personal data you provide to Fybe when reporting some kind of violation may be forwarded to the opponent of your complaint in order to process your complaint in cooperation with the opponent.
